End User License Agreement

This End User License Agreement (the "Agreement") is a legal agreement between you and Kafka's Kaleidoscope, a business operated by Joubert Bekker as a sole proprietor in South Africa ("we", "us", "our", or "the provider"). It sets out the terms on which you may install and use the Kafka's Kaleidoscope software (the "Software").
The Software is now called Sticky Keys. "Kafka's Kaleidoscope" remains the registered trading name. Both names refer to the same provider and the same Software, and this Agreement covers both.
Please read this Agreement carefully. By downloading, installing, activating or using the Software, you agree to be bound by it. If you do not agree, do not install or use the Software.
1. Introduction
Sticky Keys is a native desktop application for Windows and macOS that gives pianists real-time harmonic feedback. It visualises the key centre, the notes that are in and out of the scale, a circle of fifths, an achievement grid and a golden orb. It also includes a Teaching Mode for tracking multiple students and a Learning Library of guided lessons. The interface is available in 25 languages.
The Software is delivered as a downloadable application and the licence is activated online. A free trial version is available so you can evaluate the Software before buying.
2. The Licence We Grant You
When you buy a licence, we grant you a personal, non-exclusive, non-transferable licence to install and use the Software in accordance with this Agreement. This licence is a right to use the Software; it is not a sale of the Software itself.
For an individual licence, the licence is for your own use. For an institution or education licence, an organisation receives one licence token that activates a set number of student "seats", with one seat per student device, up to the number of seats purchased. Institution seats are managed from the Institution Admin panel in the app, on Windows or Mac.
The licence is non-transferable. You may not assign, transfer, resell, sublicense or otherwise make your licence available to anyone else, except as expressly permitted in this Agreement.
3. Activation, Devices and Seat Limits
The Software must be activated online.
- Individual licence: You may activate the Software on up to 2 devices.
- Institution seats: Each seat may be used on one student device, and you may not activate more devices than the number of seats you have purchased.
You may not share a licence token beyond the applicable device or seat limit, and you may not circumvent the licence or seat system.
4. Licence Verification and Offline Grace Period
Your entitlement to use the Software is confirmed using a signed licence file. This file is checked online from time to time to confirm your licence remains valid, and it can also be validated offline. To allow for periods without an internet connection, the Software provides an offline grace period during which it continues to work while offline. After the offline grace period ends, the Software will need to reconnect and verify your licence online to continue functioning.
5. Permitted Use
Subject to this Agreement, you may:
- install and use the Software on the number of devices or seats allowed by your licence;
- use the Software for its intended purpose, namely learning, practising and teaching piano and harmony with real-time feedback; and
- receive updates that we make available for your version of the Software.
The Software is largely local-first: your practice data, student profiles and settings are stored locally on your own device and are not uploaded to us, except for the licence and entitlement checks described in this Agreement and in our Terms of Service.
Institution licences are the one exception. Where a school or studio enrols students in a class, the class roster (each student's name as entered by the school, and the device they activate on) and their attendance dates are stored on our servers so a teacher can see their own class across devices. Each device activated on an institution seat also sends a daily practice summary for the teacher to see, whether or not it has joined a class: minutes practised, how many lessons were set, attempted, passed and completed, how many different pieces were tried, accuracy and timing scores, and practice streak. It is kept for 120 days, and deleted sooner if the device is removed from the licence or the school's data is erased. Recordings and what was played are still never uploaded, and nothing of this kind is sent for an individual licence. See sections 3, 5 and 9 of our Privacy Policy.
6. Restrictions
You may not, and may not permit anyone else to:
- reverse engineer, decompile or disassemble the Software, except to the extent that this restriction is expressly permitted by applicable law;
- redistribute, resell, rent, lease or sublicense the Software;
- share licence tokens beyond the device or seat limit that applies to your licence;
- circumvent, disable or interfere with the licence verification or seat system, or with any activation or security measures in the Software; or
- use the Software in any way not permitted by this Agreement or by law.
7. Ownership and Intellectual Property
The Software is licensed to you, not sold. We retain all right, title and interest in and to the Software, including all intellectual property rights in it. This Agreement does not transfer ownership of the Software or any part of it to you. All rights not expressly granted to you in this Agreement are reserved by us.
8. You Need a MIDI Keyboard
The Software requires a MIDI keyboard, connected by USB or MIDI cable, in order to provide real-time feedback. The Software does not include any hardware. You are responsible for obtaining and connecting a suitable MIDI keyboard, which is not provided by us.
9. Free Trial
A free trial version of the Software is available to download and evaluate before you buy. The free trial lets you assess whether the Software meets your needs. Because a free trial is available, we encourage you to evaluate the Software before purchasing a licence.
10. Subscriptions, Payments and the Lifetime Licence
Licences are available on the following terms:
- Monthly subscription: US$20 per month. It auto-renews until you cancel it.
- Yearly subscription: US$119 per year. It auto-renews until you cancel it.
- Lifetime licence: a one-time payment of US$249, with no renewals. It includes ongoing updates to the current major version, provided as free re-downloads.
- Institution / education licences: per-seat licensing for schools and organisations, priced per seat by volume and usually invoiced.
Payments are processed by PayPal, including debit and credit cards via PayPal guest checkout. Sticky Keys never stores or processes card numbers; PayPal handles all card data.
Cancelling a subscription stops future renewals. It does not by itself refund the current period, except as set out in our Refund Policy. Full payment, refund and cancellation terms are covered in our Terms of Service and Refund Policy.
11. Updates and Changes
We may issue updates to the Software from time to time. Updates are made available for you to download and install; the Software does not update itself automatically. We may also modify or discontinue features of the Software. The lifetime licence includes ongoing updates to the current major version, provided as free re-downloads using your original download link. Where an update or change materially affects your use of the Software, we will act reasonably and in line with your statutory rights.
12. Term and Termination
This Agreement takes effect when you first download, install, activate or use the Software, and continues while your licence is valid.
For subscriptions, your licence continues for as long as your subscription remains active. If you cancel or your subscription is not renewed, or if a refund is made, the associated licence is deactivated. For a lifetime licence, the licence continues subject to this Agreement.
We may suspend or terminate your licence if you materially breach this Agreement, including by circumventing the licence or seat system, sharing tokens beyond your limit, or otherwise using the Software in a way this Agreement does not permit. On termination, your right to use the Software ends and you must stop using it and remove it from your devices. Sections that by their nature should survive termination, including those on ownership, disclaimers, limitation of liability and governing law, will continue to apply.
13. Disclaimer of Warranties
To the extent permitted by law, the Software is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Software will be uninterrupted, error-free, or that it will meet your particular requirements, or that it will be compatible with any particular hardware or MIDI keyboard.
Nothing in this section limits or excludes any warranty, guarantee or right that applies to you under the Consumer Protection Act 68 of 2008 or other South African law and that cannot lawfully be excluded.
14. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss or damage, or for any loss of data, arising out of or in connection with your use of, or inability to use, the Software.
Nothing in this Agreement excludes or limits our liability where that liability cannot lawfully be excluded or limited under South African law, including under the Consumer Protection Act 68 of 2008. Where liability cannot be excluded but may be limited, our liability is limited to the minimum extent permitted by law.
15. Your Statutory Consumer Rights
This Agreement operates alongside your statutory rights. Nothing in it limits or excludes any right you have under the Consumer Protection Act 68 of 2008 (CPA) or the Electronic Communications and Transactions Act 25 of 2002 (ECTA) that cannot lawfully be limited or excluded. We offer a 14-day satisfaction refund on individual purchases, as set out in our Refund Policy; this refund is offered in addition to, and does not limit, your statutory rights under the CPA.
16. Governing Law
This Agreement is governed by the laws of the Republic of South Africa. The Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002 apply where relevant. Disputes are subject to the courts of South Africa, without limiting any statutory forum rights you may have as a consumer.
17. Changes to This Agreement
We may update this Agreement from time to time. When we do, we will change the "Last updated" date at the top of this page. Your continued use of the Software after an update takes effect means you accept the updated Agreement. If a change materially affects your rights, we will act reasonably and in line with applicable law.
18. How This Agreement Fits With Our Other Terms
This Agreement covers the licence terms for the Software itself. It operates alongside our Terms of Service, which govern your broader use of Sticky Keys, and our Privacy Policy, which explains how we handle personal information in accordance with the Protection of Personal Information Act (POPIA). If there is a conflict between this Agreement and the Terms of Service specifically about the licence to use the Software, this Agreement applies to that point.
